Terms and privacy
How the colouring aquarium works, what it keeps and who looks after it — plainly, without legal fog.
Who we are
The colouring aquarium is made by Cherish Days, a small family business in Sydney, Australia. It is free to start with and has no advertising; Aquarium Plus is an optional one-off purchase for one aquarium (see section 03).
This page covers the aquarium only. Buying from our shop is covered by the Cherish Days Terms and conditions and Privacy policy.
Questions about the aquarium: write to Cherish Days at hello@cherishdays.com.au.
The service, as it is
We look after the aquarium, but it may sometimes be unavailable, it will change, and one day it may close. If we decide to close it, we'll say so on this site well in advance, so you can save what matters to you.
If a drawing is precious, keep a copy: the management page shows every fish, and you can save the picture from your browser.
To the fullest extent permitted by law, Cherish Days is not liable for any loss that comes from using the aquarium, including lost drawings. Nothing on this page limits your rights under the Australian Consumer Law.
Aquarium Plus
A free aquarium holds up to five fish and one decoration. Aquarium Plus makes room for up to 40 fish and adds sea guests, more decorations and your own backgrounds.
- One payment, one aquarium. Plus is a one-off purchase, not a subscription. The price is shown before you pay and includes GST.
- It belongs to the aquarium, not to a person: it works on every screen where that aquarium is open. Keep the aquarium link — there is no account to recover it from. If the aquarium is deleted, its Plus goes with it.
- Payment is handled by Stripe. Your card details go to Stripe, never to us, and Stripe emails the receipt to the address you give there. We keep only Stripe's payment reference and the amount next to the aquarium.
- Codes from a kit or a gift switch Plus on for one aquarium. A code works once and can't be exchanged for money.
If Plus doesn't work as described, write to us and we'll fix it or refund you. Nothing here limits your rights under the Australian Consumer Law.
No accounts — a link and a parent PIN
- The aquarium link (with its QR code) opens the aquarium. Anyone with it can watch the aquarium, feed the fish and add new ones. That's deliberate: a child photographs a sheet by following the link, and a PIN there would only get in the way. A TV gets a temporary five-digit code that works for 5 minutes.
- The parent PIN is needed for anything that can't be undone: deleting fish or the aquarium, renaming it, changing the PIN itself. The device that created the aquarium remembers it, and it's always in the aquarium menu.
- There's no email or account behind them, so we can't recover a lost link or PIN. Without the PIN the aquarium can still be watched, but no longer managed.
So please share an aquarium's link only with people you trust.
What the aquarium keeps
- pictures of the coloured fish — whatever was photographed and released into the aquarium;
- the name of whoever drew it, if it was typed in when photographing — it shows in the caption above the fish;
- the aquarium name you chose;
- a snapshot of the scene, shown as the card in your list of aquariums;
- the backgrounds you uploaded;
- for the parent PIN, only a salted scrypt hash — the PIN itself is never stored on our server;
- for Aquarium Plus, Stripe's payment reference and the amount — no card or contact details.
Your browser also keeps, on your own device, the list of your aquariums and their
parent PINs, so you don't have to type them every time. This is ordinary page storage
(localStorage), not cookies, and the aquarium needs it to work — which is why
there's no cookie banner. It goes nowhere except our server, and it's cleared together with
the site data in your browser.
The aquarium keeps no visitor log of its own: its log only notes that a fish was added to an aquarium, with no addresses. A visitor's address is held in memory for about an hour, so that nobody can create a hundred aquariums in a minute; it never reaches the disk and is gone after a restart.
The web server in front of the aquarium keeps a standard technical access log: time, IP address, page address, response code. It rotates and overwrites itself, is used only to work out what broke when something breaks, and isn't used for analytics or shared with anyone.
There are no analytics, counters or advertising scripts on the aquarium pages. We never sell or rent this information, and we don't share it with anyone.
Deleting fish and aquariums
Fish and whole aquariums are deleted with the parent PIN: fish on the aquarium's management page, aquariums from your list on the home page. Deleted items first move to a bin on our server — in case of a misclick — and are erased for good after 30 days, automatically.
Lost the PIN and want the data gone? Email hello@cherishdays.com.au with the aquarium link and we'll delete it by hand.
Children
The aquarium is made for children, but it's set up and looked after by an adult — a parent, carer or teacher — who decides who gets the link. Children use it with that adult's say-so and under their eye.
In the “Who drew it?” field a first name or a nickname is plenty. Please don't type a child's full name or any other details.
What goes into the aquarium
The aquarium is for children's drawings of fish. You're responsible for what you upload: please don't add other people's work, anything that breaks Australian law or anything that doesn't belong in a children's aquarium.
We may remove any content, and close access to any aquarium that's being used for something else, without notice.
Your rights
We use the information above only to run the aquarium — to show you your own drawings. Under Australian privacy law, you can ask for a copy of your information, correct it, ask us to delete it, or withdraw your consent.
Fish and aquariums you can delete yourself, on the management page. For anything else, email hello@cherishdays.com.au with the aquarium code and we'll reply.
Sheets, models and our name
The colouring sheets are free to print for your own use — at home, in class or at a party.
The 3D fish models are a purchased set by a third-party author and are used under its licence. The Cherish Days name, logo and designs belong to Cherish Days.
Changes to this page
We may update this page as the aquarium changes. When we do, we'll change the date at the end of it. Questions — hello@cherishdays.com.au.
